SECTION 02
Acceptance of Terms
By accessing this website, submitting a contact form, or delivering a timepiece to the studio, you indicate that you have read and understood this Agreement and are willing to be bound by it.
Use of the studio's services is open to individuals who are at least 18 years of age, or who are accompanied by and acting under the supervision of a parent or legal guardian. By engaging with the studio, you confirm that you have the legal capacity to enter into this Agreement.
If you are acting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.
SECTION 03
Service Description
rafflesi is a specialist horological workshop offering bench services for mechanical and quartz wristwatches. The studio's current service range includes strap and bracelet fitting, chronograph and complication overhaul, and pre-purchase inspection reports.
Services are available to walk-in clients and owners who arrange delivery by prior arrangement. The studio operates from 88 Lebuh Chulia, George Town, Penang, and accepts pieces for work during published operating hours.
Service availability may vary based on current workload, parts availability, and the technical requirements of individual pieces. The studio reserves the right to decline work it assesses as beyond its current capacity or outside its scope of practice.
All services are conducted in Malaysia. The studio does not operate a postal or courier intake service by default; any arrangement to receive a piece remotely is subject to a separate written agreement.
SECTION 04
User Responsibilities
Owners who deliver a timepiece to the studio are responsible for the following:
- Providing accurate information about the piece, including known history, prior service records, and any observed faults.
- Disclosing any modifications, non-original parts, or repairs carried out by other workshops before delivery to rafflesi.
- Confirming that they are the rightful owner of the piece, or are acting with the express permission of the owner.
- Collecting the piece within a reasonable period following notification that work is complete. The studio will make reasonable efforts to contact the owner; uncollected pieces held beyond 60 days following completion notice may be subject to storage consideration at the studio's discretion.
When using this website, you agree not to submit false or misleading information, attempt to access parts of the site not intended for public access, or use any automated means to extract content from the site.
SECTION 05
Intellectual Property
All content on this website — including text, photography, layout, design elements, calibre reference notes, and written reports — is the property of rafflesi or its respective contributors and is protected under Malaysian copyright law.
You are granted a limited, non-transferable licence to view and print content from this site for your own personal, non-commercial reference. This licence does not extend to reproduction, redistribution, or adaptation of any material without prior written consent.
Inspection reports and written documentation produced for a specific piece are issued for the personal use of the commissioning owner. They may not be used as authentication or valuation certificates, and the studio does not authorise their reproduction in commercial listings or third-party publications without agreement.
SECTION 06
Payment Terms
All service fees are quoted and payable in Malaysian Ringgit (RM). Published prices represent starting or indicative figures; a precise quote will be provided following assessment of each individual piece.
Payment is due upon collection of the piece or delivery of the completed report. The studio accepts cash and common electronic transfer methods; specific payment options may be confirmed at intake.
Where additional parts or materials are required beyond the scope of the initial quote, the studio will communicate revised pricing before proceeding. Work requiring significant additional cost will not be commenced without the owner's written or verbal confirmation.
In the event that an owner declines to proceed following an assessment, a bench assessment fee may apply to cover the cost of the diagnostic work already performed. This will be communicated before the assessment begins where applicable.
The studio does not offer a general refund of service fees once work has been completed. If you have a concern about the quality of work performed, please raise it with the studio directly so that it can be assessed and, where appropriate, remedied.
SECTION 07
Service-Specific Terms
Strap and Bracelet Refit
Sizing and fitting work is carried out on pieces presented at the studio. The studio works with the materials and components available at the time of service. Where a requested strap requires sourcing, the owner will be informed of the lead time before the order is placed. Once a custom strap has been sourced or cut to specification, it cannot be returned.
Chronograph and Complication Overhaul
Overhaul work involves full disassembly of the movement. The studio documents parts condition before proceeding. Where worn or damaged components are identified, the owner will be consulted before replacements are sourced. Turnaround estimates are indicative; complex or unusual calibres may require additional time. The studio will communicate any significant change to the expected timeline.
Pre-Purchase Inspection Report
The report describes the observed condition of the piece at the time of inspection and is intended as an informational aid to the owner's purchase decision. It does not constitute an authentication certificate, a warranty, a valuation, or an endorsement of the piece or its seller. The studio does not accept liability for purchase decisions made on the basis of the report. The report reflects the state of the piece as received; the studio is not responsible for changes in condition occurring after the piece leaves the bench.
SECTION 08
Disclaimers
The information on this website is provided for general reference purposes. While the studio takes care to ensure accuracy, it does not warrant that all content is complete, current, or free from error at all times.
Descriptions of calibre families, service intervals, and horological practices are offered as general guidance and should not be taken as a substitute for a bench assessment of your specific piece.
The studio does not guarantee specific timing results for any piece. Older or worn movements may not achieve modern accuracy standards regardless of the quality of service performed.
SECTION 09
Limitation of Liability
To the extent permitted under Malaysian law, rafflesi's total liability to any owner arising out of a single service engagement shall not exceed the fee paid for that service.
The studio shall not be liable for indirect, consequential, or incidental loss, including loss of use, loss of commercial value, or sentimental loss, arising from the performance or non-performance of any service.
The studio takes reasonable care of pieces in its custody. In the unlikely event of damage occurring while a piece is in the studio's care, liability shall be assessed on a case-by-case basis and shall not automatically be assumed to extend to the full market value of the piece. Owners of high-value items are encouraged to maintain their own insurance cover.
Nothing in these terms limits liability for death or personal injury caused by negligence, or for any matter that cannot lawfully be excluded under applicable Malaysian consumer protection law.
SECTION 10
Indemnification
You agree to hold rafflesi harmless from any claim, loss, or expense arising from your breach of this Agreement, your misrepresentation of ownership or authority over a piece delivered for service, or your misuse of any report or documentation issued by the studio.
This indemnification applies to the studio's principals, workshop staff, and any contractors engaged in the completion of your service.
SECTION 11
Termination
Either party may end a service engagement before work commences by notifying the other party in writing or in person. Where the studio has already performed diagnostic or preparatory work, an assessment fee may be applicable as noted under Payment Terms.
The studio may decline to continue work on a piece if new information comes to light that changes the scope significantly, if required parts are unavailable, or if the owner fails to respond to communications within a reasonable period.
Sections of this Agreement relating to intellectual property, liability, and dispute resolution remain in effect regardless of whether a service is completed.
SECTION 12
Dispute Resolution
These terms are governed by the laws of Malaysia. Any dispute arising from or in connection with a service engagement at rafflesi shall first be raised directly with the studio, and the parties will make a reasonable effort to resolve the matter informally within 30 days of the written notice of dispute.
If informal resolution is not reached, the matter may be referred to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) where applicable, or to the courts of Penang, Malaysia, which shall have non-exclusive jurisdiction.
Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction.
SECTION 13
General Provisions
Entire Agreement. This Agreement, together with any written service quotation, constitutes the full understanding between rafflesi and the owner in relation to a given service engagement.
Severability. If any provision of this Agreement is found to be unenforceable under applicable law, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full effect.
Waiver. The studio's decision not to enforce a particular provision on one occasion does not constitute a waiver of the right to enforce it on another occasion.
Assignment. You may not transfer your rights or obligations under this Agreement without the studio's prior written consent. The studio may transfer its obligations in connection with a change of business ownership, provided that service quality obligations continue to be met.
Notices. Formal notices should be directed to the studio by email at [email protected] or in writing to the studio address.
SECTION 14
Changes to Terms
rafflesi may update these terms from time to time to reflect changes in the studio's services, operating practices, or applicable law. The date of the most recent revision is shown at the top of this document.
Continued use of the studio's website or services following the publication of revised terms constitutes acceptance of the updated Agreement. If you have a concern about a proposed change, you are encouraged to raise it with the studio directly.
